BREWS LOYALTY PROGRAM

Definitions

In these terms and conditions:

  1. Brews” means Brews Holdings Limited;
  2. Brews Loyalty Card” means the Brews Loyalty Card issued to customers.
  3. Brews Credits” means the reward points, available to be earned when purchasing liquor from Brews stores and which result in the issue of vouchers (subject to meeting the applicable requirements in these Terms);
  4. Programme” means the Brews Loyalty Programme which allows you to earn loyalty points;
  5. Terms” means these terms and conditions;
  6. we“, “us“, “our” means Brews Holding Limited;
  7. you“, “your” means any individual or company (where applicable) who has a Brews Loyalty Card.

Brews Loyalty Programme

  1. You must use your legal name on all Programme registration and application forms.
  2. Except as otherwise provided for in these Terms, you must be an individual consumer to hold and use a Brews Loyalty Card. For the avoidance of doubt, trade customers are not entitled to use the Programme for the purpose of earning points, earning vouchers, or redeeming vouchers.
  3. We reserve the right, at any time without notice, to:
    1. on reasonable grounds, withdraw or cancel your Brews Loyalty Card, and/or Brews Credits. Reasonable grounds include (without limitation):
      1. any use or attempted use by you of a Brews Loyalty Card or Brews Credits/vouchers in a manner which is contrary to these Terms; or
      2. our reasonable suspicion that you have been dishonest in connection with the Programme including if it is suspected that your rewards and/or vouchers have been earned through suspicious or unlawful practices.
    2. If we decline to issue, withdraw or cancel your Brews Loyalty Card in the above circumstances, you will forfeit any Brews Credit and/or vouchers you have accumulated and you will no longer be eligible to earn or to redeem any Brews Credits or vouchers.
    3. We reserve the right to terminate the Programme for any reason. Where we decide to terminate the Programme, we will endeavour to give you reasonable notice of termination and let you know how this will affect you.
    4. For special Loyalty Programme promotions, other terms and conditions (in addition to these Terms) may apply and we will tell you about those at the time. From time to time, Brews Loyalty Programme may provide you with exclusive personalised offers based on your individual profile. These offers will only be available to you on your registered Brews Loyalty Card.

Using Your Brews Loyalty Card

  1. You can use your Brews Loyalty Card to earn Brews Credits (subject to these Terms) only in the Brews Liquor store where you obtained your Brews Loyalty Card. If a voucher is issued under these Terms, then the voucher may only be redeemed at the Brews Liquor store where you obtained your Brews Loyalty Card. 
  2. Your Brews Loyalty Card, including any Brews Credits and vouchers, cannot be transferred, assigned or otherwise dealt with except in accordance with these Terms.
  3. Where a transaction is cancelled or where a refund occurs, any corresponding value of Brews Credits may be deducted from your account balance if it has been credited to your account.
  4. Brews Credits will not be earned on any portion of a transaction which is “cash out”.
  5. The date Brews Credits are added to your Brews Loyalty Account is the date the is “earned”. Please see below for further information in relation to expiry periods.
  6. The expiry period of Brews Credits is calculated from the date that the points are earned.
  7. We may change these Terms in relation to Brews Credits and how they can be redeemed. We will endeavour to give you reasonable notice of any such changes prior to them taking place and let you know how this will affect you, if at all.

Earning Brews Credits at Brews

  1. You must spend a minimum of $20 (including GST) in a single transaction to qualify for Brews Credits. Once the minimum spend amount has been satisfied, you will then be awarded one (1) Brews Credit for every whole $20 (including GST) spent in that transaction. In calculating the spend amount, some products are required by law to be excluded. We will exclude such products from the calculation of the spend amount where we are required to do so by law. Such excluded products include, for example, tobacco or tobacco-related products.
  2. Brews Credits may, from time to time, also be earned through bonus Brews Loyalty promotions. Additional terms and conditions (in addition to these Terms) may apply to such bonus Brews Loyalty promotions. We will tell you about these at the time.
  3. We reserve the right to change the required minimum spend and/or the number of Brews Credits awarded in respect of the minimum spend amount. In the event of this taking place we will endeavour to give you reasonable notice of any such change and either allocate any accrued points towards a voucher, or give you the benefit of such points where this is not possible.
  4. It is your responsibility to present and use your Brews Loyalty Card to gain the benefits associated with the Programme.

Redeeming Brews Credits – Brews Vouchers

  1. For every 50 Brews Credits you have earned you will receive a Brews Voucher to the value of $10 which you can redeem at Brews. Brews Vouchers are loaded to the Nominated Brews Loyalty Card as soon as they are earned.
  2. Brews Credits will not be converted to Brews Vouchers, including but not limited to, if:
    1. you owe us money; or
    2. any of the grounds at 5(a)(ii) above exist.
  3. When using your Brews Vouchers please note:
    1. any tampering or defacing of Brews Vouchers will render them invalid;
    2. Brews Vouchers can be redeemed only once to purchase goods to the value of the amount earned;
    3. you must present your Brews Loyalty Card at the checkout when redeeming your Brews Voucher(s). Brews Vouchers are valid for 12 months from the date of issue. You must redeem your Brews Vouchers before the expiry date;
    4. Brews Vouchers are non-transferable;
    5. Brews Vouchers are not exchangeable, including for cash, or Lotto products. We may also place restrictions on the use of Brews Vouchers to purchase certain products where the purchase of those products using a Brews Voucher would cause a breach of law; 
    6. No change will be given when using a Brews vouchers.
  4. We reserve the right to change the redemption amount and the dates from which Brews Credits can be redeemed. We will endeavour to give you reasonable notice of any such change and let you know how this will affect you, if at all.
  5. In the event of a lost or stolen Brews Loyalty Card which has a Brews e-voucher loaded on it, you must immediately contact us to cancel your Brews Loyalty Card to prevent your Brews e-voucher(s) from being used. We accept no liability for any Brews e-vouchers used by a third party in the event your Brews Loyalty Card has been lost or stolen.

How to cancel your Brews Loyalty Card

  1. You may cancel your Brews Loyalty membership at any time by contacting us.
  2. Please note, where you advise us that you no longer wish to be contacted by us, your Brews Loyalty membership will be cancelled. You accept that in the event this occurs, you will forfeit any Brews Credit that you have accumulated and any Brews e-vouchers that have already been loaded on your Brews Loyalty Card.

Liability

  1. Certain legislation including the Consumer Guarantees Act 1993 may imply warranties or conditions or impose other obligations including statutory consumer guarantees which cannot by law be excluded, restricted or modified. To the extent permitted by law (and without limiting any rights you may have under the Consumer Guarantees Act 1993), we will not be liable to you in connection with:
    1. your use or attempted use of a Brews Loyalty Card in breach of these Terms;
    2. any delay in replacing a Brews Loyalty Card;
    3. any loss, theft or damage to any Brews Voucher(s), including in the course of post or delivery – they cannot be reissued or replaced;
    4. any loss or damage you suffer as a result of any suspension and/or termination of your Brews Loyalty membership, or the programme, in accordance with these Terms;
    5. any tax you are required to pay as a result of, or related to, your use of your Brews Loyalty Card.

Privacy

  1. We take our responsibilities in relation to your information seriously, and comply with the Privacy Act 1993 when dealing with all of your personal information. For more information on how we collect, store, use and disclose your personal information please see our Privacy Policy. Please make sure to read this Privacy Policy as your acceptance of these Terms is your acceptance of that Privacy Policy as well.
  2. We may use your personal information to:
    1. process your registration and administer your Programme membership.
    2. send you direct marketing, by post and electronic means, including by email, phone and text/SMS.  This may include information about special offers, discounts, promotions and other information relating to our products, that we think may be of interest to you – you can opt out of receiving direct marketing by telling us in writing, or by email.
    3. understand your shopping habits and likely preferences, in order to enhance Brews products (for example, in order to offer you a better, more personalised and tailored service, send you information about goods that are likely to be of most interest to you and show you advertising and information that is most relevant to you and your interests);
    4. enter you in a prize competition and administer the prizes.
    5. improve our Programmes, including our range of Programmes and offerings generally and to ensure that they remain relevant and of interest to users.  For example, we may contact you to request that you respond to market research and surveys;
    6. assist us in investigating your claims, complaints and enquiries; and
    7. for any other purpose that you authorise.

Terms subject to change

  1. These Terms are effective from 1 January 2019. We reserve the right to change these Terms at our discretion. We will endeavour to give you reasonable notice of any changes via our Website, by email and/or by other communication methods we adopt from time to time.
